Privacy Policy

1. General provisions
1.1. This Privacy Policy (hereinafter referred to as the "Policy") establishes the procedure for processing, storing, using and disclosing personal data provided by individuals (hereinafter referred to as the "Personal Data Subject") in connection with the activities of the Charitable Organization "UNILEX Charitable Foundation" (hereinafter referred to as the "Fund"), in accordance with the Law of Ukraine "On Personal Data Protection" and other regulatory legal acts of Ukraine.
1.2. The Foundation processes personal data solely for the purpose of implementing its statutory activities, in particular to ensure humanitarian, domestic, security and other needs arising under martial law and in the post-war period, in accordance with the goals stipulated by the Foundation's Statute.
1.3. The provision of personal data by the Subject is voluntary, however, failure to provide it or its incomplete provision may prevent the Fund from properly fulfilling its obligations.
1.4. This Privacy Policy is an integral part of the terms of use of the Site, concluded between the visitor (hereinafter referred to as the "User") and the Foundation regarding the use of the site: http://unilex.org.ua (hereinafter referred to as the "Site").
1.5. When any individual visits the Site, the Foundation receives certain information about them. This Privacy Policy (hereinafter referred to as the “Policy”) applies when an individual:
- visits our website;
- registers on our website to receive charitable assistance;
- makes a charitable donation;
- provides the Foundation with their personal data in another way for communication purposes.
1.3. This Policy defines the types of information and personal data that the Fund receives from Visitors to the Fund's website, the procedure for their collection, processing and use. Information and personal data are collected, processed and used in strict accordance with the requirements of the current legislation of Ukraine.
1.5. Providing/posting information on the Site constitutes the Visitor's consent to the content of this Policy and means that the Visitor grants his/her permission for the Foundation to collect, use, and disclose/distribute personally identifiable information in accordance with this Policy.
If you do not agree to the terms of this Policy, DO NOT send us any information and immediately discontinue using the Site.
2. Types of information that the fund may receive
2.1. The Foundation collects information concerning the Visitor only if he/she has voluntarily provided the relevant information or has expressly consented to its provision and/or use. The information collected by the Foundation includes:
- Information that allows you to identify the visitor: We may collect information that allows you to identify your identity (hereinafter referred to as "Personal Data") in cases where you decide to interact with Us and provide relevant information by providing feedback or filling out individual contact or registration forms on the Site, or otherwise provide this information through the Site, including by sending requests, making charitable contributions through the Site, etc. Personal data, among other things, includes information about your name, telephone number, residential address, email address, details of your documents, other similar information.
- Secondary (technical) data: When you visit the Site, certain data is automatically recorded on the Foundation's servers for system administration, as well as for statistical or backup purposes using a number of technologies, including, but not limited to, cookies, tags, IP address tracking/URL tracking and other tools. The recorded information may include the name of your Internet service provider, in some cases your IP address, data about the version of your browser software, the operating system of the computer from which you visited the Site, the addresses of websites that you visit simultaneously with our Site and, if possible, your search parameters that led you to the Site, date/time stamps, number of clicks, advertisements viewed and so on. You can block or disable cookies on your computer, which will limit the collection of Secondary Data through the use of cookies, but in this case you will not be able to use certain functional features of the Site and your user experience may be negatively affected.
- We may also use other tracking services (third-party programs), such as Google Analytics, to understand and analyze your use of our Site. Please note that Google Analytics collects information sent by your browser as part of your web page request, including cookies and your IP address. In this case, Google also receives this information, and its use is governed by the Google Privacy Policy and/or the Google Analytics software operator; We are not a party to your relationship with third parties, such as Google Analytics operators, etc.
- Payment Information: We do not directly collect information about your payment methods, such as bank cards, etc. If you wish to make a charitable contribution through the Site, you will be redirected to the website of a third party - a payment operator, through which you can make such a payment, your payment details will be provided not to the Foundation, but to the operator of such payment operator. Please note that your data will be processed by such third party in accordance with its privacy policy or other agreement concluded with you. We are not a party to your relations with third parties, such as payment system operators, etc.
- Children's Personal Data: We do not wish to collect information about visitors under the age of 18. If a parent or other legal guardian of a child discovers that a child has provided certain information to the Site and believes that such information should be deleted, upon their request, We will take steps to delete such information.
2.2. The Foundation uses cookies to ensure the functioning of the Site, increase usability, analyze traffic, personalize content, and improve the quality of service provision.
3. Collection and use of personal data
3.1. Personal data that may be processed by the Foundation include:
- Full name, contact details (phone number, email address);
- personal identification data (series, passport/ID card number, RNOKPP);
- bank details or other payment instruments for making charitable contributions;
- other data provided voluntarily and necessary to achieve the purposes of the processing.
3.2. Personal data is collected through:
- filling out forms on the Foundation's website;
- email;
- oral or written appeal to the Fund.
3.3. Personal data is used exclusively for:
- implementation of the Foundation's statutory activities;
- providing charitable assistance;
- ensuring communication with aid recipients and benefactors, donors, partners, and volunteers;
- accounting and tax accounting;
- fulfillment of other obligations stipulated by the legislation of Ukraine.
4. Legal basis for processing
4.1. The legal basis for processing personal data is:
- consent of the Personal Data Subject;
- the need to fulfill obligations stipulated by law;
- legitimate interests of the Foundation that do not violate the rights and freedoms of the Subject.
5. CONDITIONS AND PROCESSING TIMES
5.1. Personal data is processed both with and without the use of automation tools.
5.2. The term of processing personal data is determined by the purpose of processing and/or the validity period of the Subject's consent.
5.3. The data is stored for the period necessary to achieve the purpose of their processing, but not longer than 36 months. However, you can exercise your right to have your data deleted. In this case, your data will be deleted from our servers within 30 days of your request.
6. Rights of personal data subjects
6.1. Personal data subjects have the right to:
- to know about the sources of collection and location of their personal data;
- receive information about the conditions for providing access to personal data;
- receive information about third parties to whom their personal data is transferred;
- make changes to your personal data;
- request the deletion of your personal data.
6.2. To exercise their rights, personal data subjects may contact the Fund using the contact details specified in section 10 of this Policy.
7. Transfer of personal data to third parties
7.1. The Foundation does not transfer personal data to third parties, except for:
- cases provided for by the legislation of Ukraine;
- with the written consent of the Subject;
- if such transfer is necessary for the purposes of the processing and in compliance with legal requirements.
7.2. In the event of transfer of personal data to third parties, the Fund ensures that such persons comply with the requirements for the protection of personal data.
7.3. In connection with the Foundation's participation in international programs, initiatives or in interaction with donors, benefactors, and partners registered outside of Ukraine, personal data may be transferred outside of Ukraine.
7.4. Such transfer shall be made exclusively on the condition that:
- the consent of the Personal Data Subject;
- the presence of agreements that guarantee an appropriate level of personal data protection in accordance with the requirements of Ukrainian legislation;
- or, if such transfer is necessary for the Fund to fulfill its statutory objectives within the framework of international cooperation.
7.5. The Foundation ensures that third parties to whom personal data are transferred take adequate organizational and technical measures to protect such data, in particular in accordance with the standards in force in EU countries or other jurisdictions where data protection is considered adequate.
8. Protection of personal data
8.1. The Foundation takes all necessary legal, organizational and technical measures to protect personal data from unauthorized access, alteration, disclosure or destruction. However, no method of transmitting information over the Internet or mobile means of communication, or method of electronic storage, is 100% secure. Accordingly, despite Our efforts, We cannot guarantee or ensure the security of any information that You transmit to Us using Our Site.
8.2. You confirm that you understand the risks described above, in particular, that the information provided by you may be lost or obtained by third parties, and that you will personally and independently bear all risks associated with this.
9. Changes to the Privacy Policy
9.1. This Policy may be amended or supplemented unilaterally. All amendments are published on the official website of the Fund and come into force from the moment of publication.
